One rule shapes many New York cases: comparative negligence. How Long Do You Have to File a Personal Injury Lawsuit in New York?
Most personal injury lawsuits in New York must be filed within three years of the date of the accident. If you miss that deadline, you lose the right to sue, no matter how strong your case would have been. However, the three-year deadline has important exceptions, and some of them shorten your window considerably:
- Medical malpractice claims generally must be filed within two years and six months, typically measured from the malpractice or the end of continuous treatment.
- Wrongful death lawsuits must generally be filed within two years of the date of death.
- Cases against municipalities, including cases involving town- or county-owned property or vehicles, follow special procedures. In most of these cases, a Notice of Claim must be served within just 90 days of when the claim arises, and the lawsuit generally must be filed within one year and 90 days. Claims against New York State follow separate Court of Claims procedures and may require a claim or notice of intention within 90 days.
